Ra 9262 an Anti-Domestic violence bill otherwise known as Anti-Violence Against Women and Their Children Act of 2004.
Can my girlfriend file a case against me using this law?
Yes, even your mistress as long as there is an established sexual or dating relationship or with whom you had a child. Scared now? You’d better be.
I doubt my girlfriend can file this case, who else can file?
This is considered a public offense, so anyone having personal knowledge of what’s happening or what happened can file. Is your Yaya your best buddy? Think again.
Will I be kicked out of our residence if this case was filed?
Yes and no. Even if it’s not an actual case filed to the proper court. She can still file for a protection order from your Barangay, which will decide on the matter and issue a BPO (Barangay Protection Order) ex parte, meaning even without hearing your defense.
